Iraq war veteran charged with killing his Wisconsin cop wife

MILWAUKEE (Reuters) - A decorated U.S. Iraq War veteran was charged on Thursday with gunning down his wife, a Wisconsin police officer, in a parking lot as she was on patrol duty the day before Christmas.

Benjamin Sebena, 30, who faces one count of first-degree intentional homicide, is accused of shooting his wife, Jennifer, 30, five times outside a fire station in the Milwaukee suburb of Wauwatosa early Monday.

Benjamin Sebena "laid in wait" for his wife for several hours and when she left the building, he shot her, according to the criminal complaint. He fired twice with a 9 millimeter handgun. Then he grabbed her service revolver, a .40 caliber, and shot her with that three times more.

Jennifer Sebena had told a fellow police officer earlier in December that she had been a victim of domestic violence and that her husband had put a gun to her head, the complaint said.

"He stated he had been jealous of other men with regards to his wife," investigators wrote in the complaint.

The ex-Marine from Wisconsin served two tours in Iraq, according to a testimonial video that he appeared in for his church in 2010.

On the video, the Purple Heart recipient describes recommitting himself to God after having his leg, arm and chest injured during a 2005 mortar attack in Ramadi, Iraq that took the life of a friend.

"I was a Marine. We're trained to kill. We're trained that death is OK. (I) wasn't trained how to deal with the death, but we're definitely trained to kill," he said, speaking from a church pew.

The couple met online when he was in Iraq and began exchanging emails while he was in recovering from his injuries in California. The two began dating after he returned to Wisconsin.

Sebena was interviewed for a story in the 2010 edition of the VAnguard, a magazine published by a U.S. Department of Veterans Affairs. In the article, Sebena is said to have been suffering from post-traumatic stress disorder.

A Milwaukee County Circuit Court judge set a $1 million cash bond for Sebena and scheduled a preliminary hearing for January 3.

A new analysis has found that loading up on snack foods may increase cancer risk in individuals with an inborn susceptibility to colorectal and other cancers. Published early online in CANCER, a peer-reviewed journal of the American Cancer Society, the study suggests that an eating pattern low in snack foods could help these individualswho have a condition called Lynch syndromelower their risk.

Lynch syndrome is an inherited condition characterized by a high risk of developing colorectal cancer, endometrial cancer, and other cancers at an early age. The syndrome is caused by mutations in genes involved with repairing DNA within cells.

Numerous studies have investigated associations between certain foods and colorectal cancer, and now there is general agreement that red and processed meats and alcohol consumption can increase individuals' risk. Only a few studies have evaluated lifestyle factors and colorectal cancer in patients with Lynch syndrome, though. To investigate, Akke Botma, PhD, MSc, of the Wageningen University in the Netherlands, and her colleagues collected dietary information from 486 individuals with Lynch syndrome. During an average follow-up of 20 months, colorectal polyps (precancerous lesions) were detected in 58 people in the study.

"We saw that Lynch syndrome patients who had an eating pattern with higher intakes of snack foodslike fast food snacks, chips, or fried snackswere twice as likely to develop these polyps as Lynch syndrome patients having a pattern with lower intakes of snack foods," said Dr. Botma.

The findings suggest that certain dietary patterns have an influence on the development of polyps in individuals with Lynch syndrome. "Unfortunately, this does not mean that eating a diet low in snack foods will prevent any polyps from developing, but it might mean that those Lynch syndrome patients who eat a lot of snack foods might have more polyps than if they ate less snack foods," said Dr. Botma. Because the study is observational, other studies are needed to confirm the results.

Previous work from the group revealed that smoking and obesity may also increase the risk of developing colorectal polyps among individuals with Lynch Syndrome. Thus, even though they may have inherited a very high risk of developing cancer, it may be possible to affect this risk by adopting a healthy lifestyle, including a healthy diet.

Releasing Relationship Pain - Black Love and Marriage

Often times when a relationship ends there are things left unsaid and questions left unanswered. Through the use of this technique you can resolve these issues and allow yourself to move on and let go of the past. This technique can also be used with those that are now deceased.

Sit yourself in a quiet space where you will not be disturbed. Ideally have an empty chair or seat opposite you. Close your eyes for a moment, and take a few deep breaths and allow yourself to relax and let go.

When you open your eyes imagine that you can see the person with whom things are left unsaid sitting opposite you. All you need to do is to pretend they are there, so if you think you are having problems visualising just pretend.

Say to the person whatever is on your mind, whatever you want to release. If there is a situation that you want to resolve, for example the break down of a relationship then talk about that.

When you have finished you may want a response from them. If so then go and sit in the other chair and pretend you are them answering back. Keep your mind focused on what was said when you do and allow the answer to flow. Remember that if you consciously say what you want to hear rather than what you really hear you are only cheating yourself, no one else.

When they have finished speaking, sit back in your original chair.

Keep up the conversation, moving from chair to chair assuming the other person?s persona when in their chair until the conversation comes to an end. Then return to your original chair and thank them for their time before going about your business.

This technique is incredibly valuable for letting go of pain, guilt and hurt from any sort of relationship, not just romantic relationships. Often when performing this technique you will be surprised by the answers that you receive from the other person.

Through a technique such as this you are able to finally let go of pain from the past so that you can move on. The pain that you have been holding on to from these past relationships may well have been preventing you from having the fulfilling relationship you?ve always dreamed of.

Enjoy using this technique, and remember, it can be used for many more things than just releasing relationship pain.

Ensuring Your Pet Is Safe When You Are Away

Our pets are special members of the family, and with each vacation, business trip, or weekend away, we need to ensure that they?re well cared for and safe in our absence. This quick overview of the major issues will help you arrange care for your pet.

Insurance and Vaccination

Getting organised with cat or dog insurance before your departure is important if you don?t already have insurance for your pet. You can have the certainty of knowing that you have coverage in the event that something unexpected does happen to your pet in your absence.

Pet insurance can cover everything from hospitalisation, medication, consultations, and emergency surgery, to specialist care. It?s also a good time to check that your pet?s worming program and vaccinations are up to date.

Identification

Though the chance of your pet getting lost is probably low, it?s important to properly tag and identify them. Microchipping and name tags are essential basics to arrange if you haven?t organised them yet. Microchipping might be mandatory in your area.

Boarding Kennels and Pet Hotels

If you?re planning to use a pet hotel or boarding kennel for your pet, there is a range of issues to consider when choosing your pet accommodation.

  • Premises. Do the animals there look well cared for? Are the premises clean and comfortable? Do they ask for vaccination certificates for all pets? You might be able to tour the premises before committing to a pet hotel.
  • Services. Will they exercise your pet? How often do they check animals? What?s the staff-to-pet ratio?
  • Recommendations. Asking friends and family for recommendations of boarding kennels could help you find a reputable kennel.

When you?re confident that the kennel or hotel is right for your pet, you should provide all relevant information. Written instructions are often best, and these should cover everything from medication instructions to vet contact numbers.

Pet Sitters

If you opt for having a family member or friend look after your pet, provide detailed instructions and guidance for proper care. A set of typed instructions that covers the basics is a good start. Include information on any special dietary requirements, medications, exercise routine, habits, vet contact details, and other relevant information.

Make it easy for your pet sitter to take care of your pet in the way you want them to. Provide sufficient dog or cat food for the duration of your trip. Don?t forget about your emergency contact number for getting in touch while you?re away.

You should be confident that your pet sitter will take proper care of your pet while you?re away. Have your pet meet their sitter before dropping your pet off, where possible. Check their background and ask for references if there?s any doubt.

Elderly Pets

Elderly pets often need specialist attention. If you have an elderly pet, you might want to take extra care in choosing a sitter or boarding house. Many pet hotels and boarding kennels offer additional services for older animals. These can include extra personal attention, medication administration, or the option for less exercise.

If You Do Decide to Take Your Pet With You

Sometimes it?s not difficult to arrange a pet-inclusive trip, especially if it?s a visit for leisure rather than business. When it comes to pet friendly short stay apartments, Sydney, the other capital cities, and other visitor friendly areas in Australia can often accommodate pets. Check in advance for their house rules for pets if you do decide to take your pet with you on your holiday.

Mentally Ill

Renee is mentally ill ? meaning her illness is all in her head. She is not exactly a hypochondriac but she certainly has hypochondriac-like tendencies. Renee will feel a part of her rib and believe she is feeling a malignant growth. On another day she?ll consider the tingle in her left arm the onset of a major heart attack.

Aside from her ?mental illness? she makes a great English teacher because, despite any faults, Ms Renee Cumberbatch has redeeming qualities. She has the ability to leave her personal life at the door of her classroom. When she steps through the door she is the consummate professional there only for the sake of her students.

That particular redeeming quality ended at the school yard at 3 pm. By the time Renee drove off she was prone to fall right back into her usual pattern of complaining about the little things. Her girlfriend Barbara would grow weary of Renee?s complaints but would overlook them in favor of the good things Renee offered.

Tonight, Renee had droned on and on about her requirement to renew her teaching license every 5 years. Barbara had barely walked in the door before Renee pulled into her driveway and she didn?t know if she was up for it today. She had had a long day and she knew what that frown on Renee?s face meant.

Good ole patient Barbara had invited her to stay for dinner anyway, and after a glass of Chardonnay, Renee was in full complaint mode. Barbara relaxed, determined to hear her friend out with an open mind.

?Why should I have to renew my license at all?? ?If the district wants me to earn 15 credits in five years then shouldn?t they pay for it? ?$350 for just 5 credits!? Barbara patiently reassured Renee that it was important for teachers to refresh their teaching methods and keep current with the new trends in education.

Ms Renee Cumberbatch was slightly mollified and when she got home that evening she began her search for a continuing education course. The first course she chose, ?Step By Step Drawing,? was an interesting looking drawing course where she could have fun with basic sketching.

If anyone had asked Renee if she thought herself mentally ill Renee would have replied that we are all mentally ill to some degree and gone on to ask you why you asked. Renee was completely confident that what she believed and how she behaved was the only sane way to think and behave.

Anyone who thought otherwise was an idiot.

(AP) ? A judge on Thursday ordered Chris Brown to remain on supervised probation and make another court appearance after he completes an overseas tour.

Superior Court Judge Patricia Schnegg did not address questions raised at a previous hearing about whether the R&B singer had completed the terms of his community labor sentence.

A prosecutor said a report filed for Thursday's hearing did not add additional details about Brown's service as previously requested by the court. Instead, it included the same spreadsheet of Brown's hours that Schnegg called "somewhat cryptic" at a September hearing.

Brown remains on supervised probation for felony assault for an attack on Rihanna in 2009.

He is scheduled to begin a tour that spans several countries in Europe and South Africa on Nov. 14.

Brown "appears to be making a sincere effort to comply with terms and conditions of probation," a probation officer wrote in a report prepared for Thursday's hearing. The report recommended that Brown remain on probation under the same conditions he has abided by since pleading guilty to the attack on the eve of the Grammy awards.

Brown appeared at the hearing along with his mother and attorney Mark Geragos. He did not speak during the proceedings, and when he attempted to at one point during discussions of his schedule, Geragos joked, "I don't dance, you don't talk."

Brown is scheduled to return to court Jan. 17.

First-ever 3-D stress map of developing embryonic heart sheds light on why defects form

ScienceDaily (Oct. 31, 2012) ? As a human fetus develops, its heart has to keep pace with the new body's ever-growing demands. Much of this is controlled by following genetic blueprints, but the embryonic heart also matures in response to the intense stresses of pumping blood. For the first time, researchers have been able to visualize in 3-D the stresses induced by flowing blood in an embryonic heart.

The technique, which promises to provide new insight into how and why heart defects develop, is described in a paper published today in the Optical Society's (OSA) open-access journal Biomedical Optics Express.

The researchers, led by Andrew M. Rollins, an associate professor of biomedical engineering at Case Western Reserve University in Cleveland, looked at a particular type of stress in the heart known as shear stress, which is simply the parallel force of one material sliding along another. In the developing heart, shear stress is induced in the heart's own endocardial cells as blood cells rush past them. Normally, such shear stress helps to control and regulate cellular processes involved in heart development. Even tiny aberrations in the heart beat, however, can alter blood flow patterns and change these developmental forces, leading to congenital heart defects such as abnormal valve formation.

"All previous attempts at shear-stress mapping have been two dimensional, but the 3-D geometry of the embryonic heart is changing hour by hour at these early stages, and the shape of the heart twists and turns as it develops," says Rollins, "so a 2-D projection doesn't really provide a good approximation."

Rollins and his colleagues at Case Western Reserve developed their new imaging method by modifying a technique called Doppler optical coherence tomography, or OCT. In OCT, a beam of infrared light is shined on a tissue and the "echoes" (or reflections) of that light produced at varying depths are used to make an image. "It is just like RADAR or ultrasound," Rollins explains, "except we use infrared light and we image tiny things at really high resolution." The technique has been used to image the interior of blood vessels and is routinely used by ophthalmologists to examine the retina.

"We can use this technique to figure out just how function or dysfunction fits into normal heart development and the development of heart defects," Rollins adds. "An understanding of normal and abnormal development is critical for preventing and treating these defects."

In laboratory experiments, Rollins and colleagues directly measured the heart structure and blood flow within the developing hearts of quail embryos. The data was then used to create 4-D images (basically, 3-D movies), which showed that "locations of high shear correspond with locations of future valve formation," he says. "Now we are investigating the effects of abnormal shear caused by alcohol exposure on valve development."

The researchers hope to take what they have learned from these preliminary animal tests and develop a way to apply this technique to humans. The ultimate goal is to develop a tool that doctors can use to decide if early intervention could put a developing heart back on the right track, preventing a defect.

The other co-authors on the Biomedical Optics Express paper are Lindsy Peterson, graduate research assistant, Michael W. Jenkins research assistant professor of biomedical engineering, and Michiko Watanabe, a professor of pediatrics, anatomy, and genetics, all at Case Western Reserve.

ASIS International Extends Deadline for 2012 Student Writing ...

The ASIS Academic and Training Programs Council and the ASIS Foundation have extended the deadline for the 2012 ASIS International Student Writing Competition.

The writing competition rewards college and university students who "conduct research, engage in thoughtful deliberation and write an academic paper between 3,000 and 6,000 words on an issue relevant to the security and assets protection profession."

The competition is open to any student, full or part-time, studying at an accredited institution pursuing an associate, bachelor or master?s degree. The original deadline was November 9 but has been moved to December 14.

?The objective of this competition is to encourage critical thinking to help make our world a safer and more secure place to live, work, govern, and conduct business,? says Kevin Peterson, CPP, coordinator of the Student Writing Competition and a member of the ASIS Academic and Training Programs Council.

Students have the option to select one of six topics for their paper. The topics: the most promising technologies to meet tomorrow?s security challenges; improving the image and reputation of the security profession; protecting information and intangible assets in the 21st century; leveraging low-cost/low-tech solutions for contemporary security challenges; the impact of globalization on security, assets protection and organizational resilience; and the challenge of securing cyberspace.

A three-person review committee affiliated with academic institutions, including a member of the ASIS Academic Programs Council, will judge the submissions. Click here to view an expanded description of the topics.

Cash prizes include $1,500 for the graduate winner, $1,000 for the undergraduate winner and $500 to honorable mention winners at the graduate and undergraduate levels.

As cleanup efforts continue across New York, New Jersey, and Connecticut, some of America?s largest telecommunications companies are coming under increased scrutiny for being caught flat-footed after Hurricane Sandy roared across the tri-state region, causing damage Verizon?s chief technology officer now admits is worse than 9/11.

As of this morning, Verizon Wireless? network is reportedly straining, particularly in Manhattan and Brooklyn, where cell service that worked immediately after the storm is now increasingly failing.

Verizon said 94% of its cell sites were operational after the storm, but some local officials in the area believe 94% of Verizon?s wireless network has now failed them when they need it the most.

Many telecom companies, particularly AT&T, are being criticized for excessive secrecy about the ongoing state of their networks post-Sandy. AT&T, which left its customers in the dark about service restoration as late as last night while asking customers to contribute $10 to the American Red Cross, finally mass e-mailed customers a statement devoid of much detail signed by Steve Hodges, president of AT&T?s northeast region.

?Restoring our wireless network is our top priority,? Hodges writes. ?The vast majority of our cell sites in the Northeast are online and working. We are working issues in areas that were especially hard-hit, where flooding, power loss, transportation and debris all pose challenges. Our crews are working around the clock to restore network service to areas that were impacted by the storm. We will not stop until we repair all of the damage to our network and restore service back to its full capacity.?

The Federal Communications Commission correctly predicted?the situation with mobile phones could get worse before it gets better, as backup power wears down and flooding persists. At a press conference held yesterday, FCC chairman Julius Genachowski revealed at least a quarter of all cell sites in areas damaged by Sandy were not operational. Those numbers were less optimistic that those provided by carriers.

The FCC this week activated the?Disaster Information Reporting System, a central reporting point for telecommunications companies to update the agency regarding outages and other service disruptions. The FCC also alerted providers that in emergency circumstances, they can assist companies getting fuel for generators and help locate portable cell tower equipment for companies caught unaware.

The Federal Emergency Management Agency (FEMA) today told Sen. Chuck Schumer the federal agency will reimburse New York for 100 percent of the costs incurred restoring power across the storm areas. But that may not expedite how quickly power returns.

Power restoration is expected to bring most cell towers back online. Worsening service is being attributed to battery backup or generator equipment exhausting on-hand fuel supplies, which usually keeps service up and running for up to three days. That means cell towers without power and unreachable by workers will have begun failing late Wednesday into today.

Damage assessments are further behind in New Jersey, the state that took the worst impact from Hurricane Sandy.

Residents are trading tips about ?magic spots? where cell service does suddenly pop up, and Gizmodo notes?the only place in Alphabet City (the east side in southern Manhattan) to get service is on literally one street corner, where crowds congregate to make and receive calls.

The other salve for telecom withdrawal is the nearest pay phone.

Amusing stories of 20-somethings waiting in long lines only to be confounded by unfamiliar pay phones are appearing in the New York media. One radio station even aired basic instructions for members of the Millennial Generation that have never heard of inserting coins into telephones.

The biggest challenge for the city?s pay phone vendors is clearing them of coin overloads, something unheard of before the storm.

The often maligned pay phone has exposed the limits of the ?more advanced? and expensive networks that were supposed to replace them. Despite claims of superiority for wireless service, northeast residents have once again discovered it has its limits:

  • They don?t work during major weather events that knock out power and limit access to maintain backup generators;
  • Cell networks are less capable of handling large call volumes, a problem made worse when cell phone refugees in other areas seek out remaining cell signals, further congesting the network;
  • Wireless is just as susceptible to wireline or fiber failures on the ground. Cell towers typically connect to providers through wired backhaul circuits, which knock out cell service if they fail;
  • Cell phone users need power to recharge their power-hungry smartphones. Batteries drain even faster searching for a weak or non-existent cell signal;

Hardest hit remains Verizon, which allowed reporters access inside damaged facilities to help New Yorkers better understand the scope of the problem.

The Wall Street Journal takes a look at the state of the wireless communications networks across the northeastern U.S. and when service will be back. ?(4 minutes)

Eleven years after the 9/11 terrorist attacks that took out Verizon?s West Street office when buildings collapsed at the nearby World Trade Center, Verizon is likely going to have to re-learn some lessons about catastrophe management as flood waters recede.

Verizon has deployed this 53-foot Emergency Mobile Communications Center for use by the Nassau County Office of Emergency Management that provides Internet and phone service.

The Wall Street Journal was able to obtain access inside the damaged facilities, and the reporter covering the event was left somewhat stunned by the scope of the damage.

In the middle of organized, yet chaotic recovery efforts was Verizon?s chief technology officer Tony Melone who had seen enough to declare the damage worse than 9/11.

The pictures of several feet of muddy water from the nearby Hudson River covering the lobby of the company?s headquarters on West Street said it all. The mostly salt water was an unwelcome guest in Verizon?s building, especially considering the five level basement below the lobby contains critical cables and telecommunications equipment. Almost four of those basement floors were completely flooded. After the water was pumped out, dampness and leaves from nearby trees remain littered on the floor.

One lesson learned after 9/11 was not to place critical phone switches below ground level. After reconstruction, the switches were moved to a higher floor and consequently were left undamaged.?But while Verizon moved its backup generators upstairs, it left the pumps and fuel tanks that power them in the basement ? leaving them inoperable.

This morning, passersby on West Street have to step around Verizon?s network of generators now running outside of the building, right next to large temporary fuel tanks to power them.

Verizon central offices in other parts of Manhattan, particularly further southeast on Broad Street, were never upgraded and are in worse shape, with electrical equipment damaged perhaps beyond repair.?The force of the water was strong enough to bend the 86 year-old steel and bronze doors. Workers there are still trying to get water out of the building, shoving a pipe down an elevator shaft to facilitate pumping.

Verizon has some redundancy built into its network to protect its most valuable customers. That kept the landline phones working at the New York Stock Exchange, even though other landline and wireless customers will have ?to wait longer for service to resume.

Some critics of the increasingly concentrated telecommunications landscape think Verizon and other companies have still not learned enough to prevent the kinds of service disruptions that will leave some customers without service for weeks.

It is hard to miss the bustle outside of Verizon?s offices damaged by the storm, watching flood water drain down the street. But things are murkier at cell phone providers who have been less than forthcoming about specific outage information and service restoration assessments.

Some have advocated the federal government step in and require cell phone service, now deemed essential by an increasing number of Americans, be protected with robust backup solutions to keep service up and running after catastrophic weather events.

After Hurricane Katrina, the FCC in 2007 tried to issue new rules that required a minimum of eight hours of backup power for all cell sites. The industry balked, predicting it would lead to??staggering and irreparable harm? for the cell companies. One wireless trade association warned their members might take several cell sites down if they were forced to provide backup power.

The CTIA Wireless Association and Sprint-Nextel sued the agency in federal court and the Bush Administration?s?Office of Management and Budget eventually killed the proposed regulations.

T-Mobile and AT&T have cut an emergency deal to share their cellphone networks in areas affected by Superstorm Sandy. They?re trying to make it a little easier for customers to get a signal as carriers restore their networks. Some say companies should be forced to make their networks more resilient. Adriana Limon walked the 50 miles from Portland?s Pioneer Courthouse Square to the Capitol in Salem so that someday her family can move back to Portland.

Her family moved from Oregon, which since 2008 requires proof of legal presence for issuance of driver?s licenses, across the Columbia River to Washington, which does not.

?We had to leave behind a house we had for 14 years,? she said Tuesday as she and others prepared to present petitions with 5,000 signatures to Gov. John Kitzhaber. ?It?s sad, because we left our community, our friends, our house ? where we had a lot of memories ? just to move to Washington to get a license.?

Oswaldo Monroy chose to stay in Portland, but was arrested June 1 for driving without a license. His arrest triggered a hold by federal immigration officials, although he has not been deported.

?I get up at 5:30 every single day, working at two jobs, and I feel I?m still not making it,? he said at a rally at the Capitol. ?With a license I could get a better job and I could do my personal business. It?s stressful, but with a car, it could be avoided.?

A small group of walkers made the trek to Salem via stops in Oregon City, Canby and Woodburn. They arrived Monday night and walked Tuesday from the fairgrounds to the Capitol, where they were joined by others.

About 60 people at the rally want Kitzhaber to take steps to restore access by undocumented immigrants to licenses. Rules have become more restrictive since a 2007 executive order by then-Gov. Ted Kulongoski and a 2008 law by the Legislature.

Proof of legal presence in the United States ? such as a birth certificate, passport or tribal ID ? is a requirement for obtaining a driver?s license or nondriver identification card in Oregon and most states.

The changes were enacted to comply with the federal Real ID Act of 2005, which requires states to take specified steps to make driver?s licenses more secure if licenses are used as identification to board commercial aircraft or enter federal buildings.

The federal law does allow states to issue licenses without proof of legal presence if they are clearly marked as invalid for federal identification purposes. Washington and New Mexico issue such licenses, although Washington also issues an ?enhanced? license that can be used for federal identification purposes and for travel to and from Canada.

A smaller group from the rally, including Jayme Limon, met with Frank Garcia, Kitzhaber?s adviser for diversity.

Limon said at the rally that Kitzhaber has listed education, health care and jobs as his top priorities.

?Unfortunately for undocumented immigrants, not having a driver?s license affects all three,? he said.

Among those watching was Anne Galisky of Portland, producer of ?Papers,? a 2009 documentary about youths without immigration documents. Her next documentary is ?14,? about how the U.S. Constitution was amended after the Civil War to grant automatic citizenship to those born in the United States. Some people want to repeal that section of the 14th Amendment.

?I know Gov. Kitzhaber will be welcoming and trying to do his best to work things out,? she said.

Kitzhaber has assigned a group of officials to look into alternatives, including a form of identification used in Mexico. But immigrant advocates call it a partial solution, and critics say it goes too far.

Hundreds came to the Capitol on April 18, 2011, in support ? and opposition ? to a bill allowing Oregon to issue licenses without proof of legal presence. But the Senate committee hearing took place after a deadline to advance legislation, and the bill died.

?We are doing the best we can,? Adriana Limon said. ?We definitely want driver?s licenses back. We will see what happens.?

9. ?A Tucson ground lease for an under-construction McDonalds, 2130 W. River Rd., was sold by La Cholla LLC for $2.2M ($1.7M/acre) to Levine Investments LP. Marcus & Millichap represented both sides of the 20 year deal.

10. ?Tibshraeny Plaza, 918 W. Southern Ave., Mesa, a 26K SF with 40 percent occupancy was sold by Tibshraeny Companies, Inc., Mesa, to Dickenson-Phoenix LLC, Scottsdale. CBRE represented the seller, AZ7 Real Estate, the buyer. A price was not disclosed.

New Lease Deals

11. ?Goodwill of Central Arizona is the newest tenant in the Thunderbird East retail complex at E. Thunderbird and Scottsdale roads, Scottsdale. An October 26th opening date is scheduled for the 35K SF retail outlet. Velocity Retail Group handled the transaction for landlord CW Capital Asset Management, LLC.

12. ?Planet Fitness signed a 34K SF lease for an old Circuit City location at Sky Festival Mall. The tenant was represented by NAI Horizon; the lessor was represented by Velocity Retail Group and De Rito Partners.

13. ?Mega Furniture USA is opening in December in the Costco Plaza at Priest and Elliott, Tempe. Velocity Real Estate handled the deal for the landlord CP Center 06, LLC/ACF Properties.

14. ?The Mexican Consulate has relocated into downtown Phoenix in the McDowell Corporate Center, 320 E. McDowell Road in Phoenix.? CBRE represented the landlord, Abart Properties 26 LLC, Scottsdale; the tenant was represented by Colliers International.? The 25K SF office takes up 70 percent of the building leaving the remaining portion available for lease.

15. ?Home builder K Hovananian Homes renewed a lease for 20K SF covering 96 months in the Desert Ridge Corporate Center, 20860 N. Tatum Blvd., Phoenix. Lee & Associates represented the landlord, Faison, Charlotte, N.C., and Cassidy Turley handled the tenant negotiations in the Class A, four-story building.

16. ?SRS Real Estate Partners handled a 12.5K SF lease for Dollar Tree in Desert Sky Esplanade, McDowell Rd. at 75th Ave., Phoenix. The dollar store joins Walmart, Staples, Ross and Big Lots in the complex.

17. ?O?Reilly Auto Parts signed a new lease for 12.3K SF in Madison Square, 5343 N. 16th St., Phoenix. Lee & Associates represented the lessee in its relocation from its current location at 7th St. and Missouri Ave. Cassidy Turley represented owner Orsett Properties, Ltd.

18. ?Harvest Bible Church inked a deal for 10.6K SF, 101 E. Comstock, Chandler in the Arizona Corporate Plaza. Cassidy Turley represented both sides of the deal. Pacific Plaza LLC is the landlord. The Chandler location is a new congregation for the east valley in addition to its existing location at 48th St. and Cactus Rd., Phoenix.

19. ?In little news, Mini Cooper is moving into the old Tucson Kia dealership, 4633 E. 22nd St., during first quarter 2013. This will be Tucson?s first Mini Cooper dealer and run by Royal Automotive Group.

Closures and Foreclosures

20. ?A report by Marcus & Millichap says that even with the rising market, Phoenix still has more than $1.5B in distressed retail inventory. Sales activity in this segment is still dominated by REO and short sales. The major victim in the market downturn is the strip mall purchased or refinanced during the height of the market. Many balloons are maturing and landlords are faced with high vacancy rates and inadequate access to capital for refinancing.

21. ?A 273K SF office project adjoining the Broadway Curve, Phoenix, has been placed into foreclosure. The Sky Harbor Towers is slated for the auction block on January 15. The complex has a seven-story building with 117K SF and two four-story midrise units with 85K SF and 71K SF respectively. Colliers International has the leasing assignment for the mostly vacant building. Originally occupied by the University of Phoenix?taking three of the buildings?the properties were vacated in 2011 when the college opened its own facilities a little further west on I-10.
