Group fails in bid to recall polarizing sheriff

PHOENIX (AP) ? A campaign to force a recall election against the polarizing sheriff of metropolitan Phoenix failed on Thursday after recall organizers said they couldn't collect enough voter signatures to bring the lawman to the ballot again.

Organizers of the recall effort against Maricopa County Sheriff Joe Arpaio needed to turn in more than 335,000 valid voter signatures by 5 p.m. Thursday to force a recall election.

"It is a sad day," said recall campaign manager Lilia Alvarez. "It is a disappointment."

Recall organizers won't reveal the number of signatures they gathered. That said, the last update they gave on their numbers five weeks ago was that they gathered 200,000 signatures.

"The count at this point doesn't matter," Alvarez said in deciding not to reveal the number of signatures gathered.

Arpaio issued a statement suggesting that recall organizers aren't revealing the number of signatures they gathered because they are embarrassed by the level of their failure. "This effort failed because the good people of Maricopa County, whom I'm honored to serve, rejected the wrong-headed idea of overturning an election," Arpaio said.

Arpaio supporters say the sheriff won re-election in November fair and square and that recall organizers shouldn't have been allowed to contest the election simply because they didn't like the outcome.

The recall effort began just weeks after the 80-year-old Republican sheriff started his sixth term in January. His November re-election race marked the second closest contest in his 20-year political career. He beat the closest candidate by 6 percentage points.

Joshua Spivak, a recall expert and senior fellow at Wagner College in New York, said the Arpaio recall effort suffered from too little fundraising, having to collect an unusually high number of voter signatures for a county race and not having an alternative candidate lined up to run against Arpaio. "They are running against Joe Arpaio," Spivak said. "But who are they electing?"

Arpaio critics had argued that the sheriff should be booted because his office has failed to adequately investigate more than 400 sex-crimes cases, has cost the county $25 million in legal settlements over treatment in county jails and his office was found by a federal judge to have systematically racially profiled Latinos in his signature immigration patrols. Critics say the sheriff is more focused on getting publicity for himself than protecting the people.

Recall organizers had hoped that last week's racial profiling ruling would pump new life into their cause. Supporters were camped outside a county building for more than four days in their final push.

"I wish from the bottom of my heart that this ruling would have come out a month earlier. Had this ruling come out a month earlier, who knows how many signatures we would have gotten," Democratic state Rep. Martin Quezada of Avondale, a supporter of the Arpaio recall effort, said.

In the hours before the recall petitions were due, a trickle of people dropped by three tents set up by recall organizers outside the county building to sign petitions. Clipboard-wielding volunteers hit up people walking on the sidewalk for signatures and wore T-shirts that said, "Petition Posse," a play on Arpaio's posses whose volunteer members assist sheriff's deputies in some of their duties.

In the past, the sheriff has apologized for the bungled sex-crimes investigations and said his office has moved to clear up the cases and taken steps to prevent a repeat of the problem. He also has vigorously denied allegations that his deputies racially profiled people in traffic patrols targeting immigrants who aren't authorized to be in the country.

Recall organizers were trying to build on the success of a 2011 recall effort that ousted then-Arizona Senate President Russell Pearce, an Arpaio ally who was the driving force behind the state's contentious 2010 immigration law. But the scale of the Arpaio recall was more daunting.

Only 7,700 valid signatures were needed to trigger the Pearce recall election.

Currently up for $50,000 in funding on Kickstarter, the Wheelharp delivers the sounds of a chamber string orchestra via a keyboard and a full chromatic set of real strings. Oh, and it's pretty much the most striking instrument we've ever seen. Developed by Los Angeles-based Antiquity Music, the device reacts to a user's press of the keys by moving a corresponding string to a rotating wheel with an edge that bows the string. The instrument gives the player plenty of controls; the right pedal controls wheel speed, while the left mans the strings' damper system.

Though an early version was demoed at NAMM this year, the Wheelharp is currently in R&D mode, and Antiquity plans to put much of the Kickstarter money toward researching the optimal string selection. Hit up the source link to hear the instrument in action. Just don't get too excited; the instrument will retail for a cool $12,500 -- or a slightly more palatable $10,000 through the crowdfunding site.

Thermal limit for animal life redefined by first lab study of deep-sea vent worms

May 29, 2013 ? Forty-two may or may not be the answer to everything, but it likely defines the temperature limit where animal life thrives, according to the first laboratory study of heat-loving Pompeii worms from deep-sea vents.

The research was published May 29 in the open access journal PLOS ONE by Bruce Shillito and colleagues from the University Pierre and Marie Curie, France.

The worms, named Alvinella pompejana, colonize black smoker chimney walls at deep-sea vents, thrive at extremes of temperature and pressure, and have thus far eluded scientists' attempts to bring them to the surface alive for further research. Many previous studies conducted at these sites has suggested the worms may be able to thrive at temperatures of 60 C (140 F) or higher. As Shillito explains, "It is because several previous papers had come to this conclusion that Alvinella had become some sort of thermal exception in the scientific world. Before these studies, it was long agreed that 50 C was the limit at which animal life survived."

In this new study, researchers used a technique that maintains the extreme pressure essential to the worms' survival during their extraction, allowing them to bring Pompeii worms to their labs for testing. They found that prolonged exposure to the 50-55 C range induced lethal tissue damage, revealing that the worms did not experience long-term exposures to temperatures above 50 C in their natural environment. However, their studies found that the temperature optimum for survival of the worms was still well over 42 C, ranking them among the most heat-loving animals known.

I?m a stay-at-home dad to twin 4-year-old girls who are already smarter than me, and my wife is a brilliant doctor who kicks ass and saves lives every day. I grew up with big sisters and a mom whose authority was unbreachable. I celebrate every inroad that women make into business, technology, science, politics, comedy, you name it, and I get angry about ?slut-shaming? or ?stereotype threat? or whatever is the affront du jour. And yet, in the caveman recesses of my imagination, I objectify women in ways that make Hooters look like a breakout session at a NOW conference.

In Louis C.K.?s comedy special, Live at the Beacon Theater, the stand-up, who in his own way has been making feminism funny for years, talks about being ?sick of the constant perverted sexual thoughts? that intrude on his day-to-day life. Women who claim that they have equally hardcore erotic thoughts, he says, are just ?tourists in sexual perversion? whereas men are ?prisoners.? ?You?re Jane Fonda sitting on the tank,? he says to the hypothetical woman who boasts of being as dirty-minded as men. ?I?m John McCain in the hut ? it?s a nightmare ? I can?t lift my arms.? He then illustrates how his condition plays out when he can?t even ask a librarian about a book on Lincoln without aggressive pornographic daydreams turning him into a slavering idiot. ?I just want to have a day [without the perverted thoughts],? he laments, ?I just want to be a person, in clothes, walking in a store.?

When I first saw this routine, I was as relieved as I was entertained. Somebody else out there had the same ?affliction? as I did! It may not be as pronounced as it was in my teens and 20s, but it?s still there, as if a never-ending porn movie has been playing in my subconscious for the last 30 years, and any lull in cognitive demands, or interaction with a woman who is perfect for a cameo in it?the woman walking her dog past my house, the neighbor?s nanny, the Valkyrie on the elliptical trainer at the gym?rotates the film to the main screen. In 3-D.

I assume that my ?condition? is perfectly normal, because many friends I?ve consulted have admitted that they, too, might have graphic daydreams about a woman they saw for five seconds at a traffic light. And indeed, the academic research on the subject corroborates my informal polling. But I couldn?t get over the cognitive dissonance of the whole situation. How could enlightened, feminist guys like myself put up with these unbidden fantasies that violate our dedication to gender equity and basic human decency? There must be like-minded men who have overcome these impulses. I decided that I would seek out their stories, and use them to help me cleanse my filthy mind.

I first asked Joanna Schroeder, senior editor and writer at The Good Men Project, for some advice. She directed me to a recent piece on Everyday Feminism, which suggested that avoiding the visual stimulus could decrease the perverted thoughts. ?I can choose to avert my eyes,? wrote James Utt. ?I can choose to briefly look and move on. I can choose to show the woman the respect she deserves by holding her eye contact while we talk.? We are not, he claims, slaves to our subconscious. Yes! I thought. I can feel the shackles falling away!

I asked the often controversial feminist writer, Hugo Schwyzer, who teaches history and gender studies at Pasadena City College, if he knew of any research that had been done on how to avoid being ?plagued by intrusive sexual thoughts.? His suggestion? ?The "affirm and redirect" strategy.

?Sure, you want to lift this woman up onto the counter and put your hungry mouth on hers while she wraps her legs around you, but in fact, you're just going to order your latt?, smile politely and let it all be.

Lust is the background music that occasionally gets turned up. Learning to let it come and go without being ashamed?and without making it anyone else's problem?is part of growing up.?

OK, so I had two potential tools: 1) Try not to ogle; and 2) Don?t freak out if I catch myself ogling or fantasizing.

I decided to kick it up a notch and see what kind of wisdom I could glean from the sexual addiction community. I called the toll-free number for Sexual Addicts Anonymous, and had a chat with what seemed to be the nicest guy in the world. He explained to me, gently, that their program was designed to deal with dangerous and destructive behaviors, and that lessening the annoyance of ?normal? fantasies was not in their purview. ?But,? I protested, ?based on the addiction self-assessment phone survey, it seems like a spectrum, really. I mean, every man I know would have to answer ?yes? to some of those questions. Who hasn?t kept secrets about their sexual fantasies? Whose fantasies haven?t conflicted with their morals or spiritual journey? Whose sexual preoccupation hasn?t caused them some kind of problem??

USDA: Unapproved modified wheat in Oregon field

(AP) ? Field workers at an Eastern Oregon wheat farm were clearing acres for the bare offseason when they came across a patch of wheat that didn't belong.

The workers sprayed it and sprayed it, but the wheat wouldn't die. Their confused boss grabbed a few stalks and sent it to a university lab in early May.

A few weeks later, Oregon State wheat scientists made a startling discovery: The wheat was genetically modified, in clear violation of U.S. law, although there's no evidence that modified wheat entered the marketplace.

They contacted federal authorities, who ran more tests and confirmed their discovery.

"It looked like regular wheat ," said Bob Zemetra, Oregon State's wheat breeder.

No genetically engineered wheat has been approved for U.S. farming. U.S. Department of Agriculture officials said the wheat is the same strain as a genetically modified wheat that was legally tested by seed giant Monsanto a decade ago but never approved. Monsanto stopped testing that product in Oregon and several other states in 2005.

How the modified wheat made it from a private company's testing grounds to the Eastern Oregon commercial wheat field is a question investigators are trying to unravel in a mystery that could have global implications on the wheat trade in the U.S. and abroad.

Many countries around the world will not accept imports of genetically modified foods, and the United States exports about half of its wheat crop. Zemetra said the presence of the modified crop shows the need for testing.

"We'll need to develop or implement a method for testing some of the grain to see for the first year or two," Zemetra said.

An Oregon State wheat scientist and a graduate student did the first tests and discovered the likely presence of a gene that made the wheat resistant to herbicide.

The genetically-modified wheat grew on land that was supposed to be rotated, said Mark Flowers, Cereal Specialist at Oregon State University Extension. The field was in an off-year and in May 2013, it was supposed to be fallow and bare. Workers expected to kill off the few rogue plants that poked out of the ground.

But those plants resistant to the herbicide caught their attention.

"That's when this was noticed," Flowers said. "Some of the wheat did not die."

USDA officials declined to speculate whether the modified seeds blew into the field from a testing site or if they were somehow planted or taken there, and they would not identify the farmer or the farm's location.

The discovery also could have implications for organic companies, which by law cannot use genetically engineered ingredients in foods. Organic farmers have frequently expressed concern that genetically modified seed will blow into organic farms and contaminate their products.

U.S. consumers have shown increasing interest in avoiding genetically modified foods. There has been little evidence to show that modified foods are less safe than their conventional counterparts, but several state legislatures are considering bills that would require them to be labeled so consumers know what they are eating.

While most of the corn and soybeans grown in the United States are already modified, the country's wheat crop is not.

The tests confirmed that the plants were a strain developed by Monsanto to resist its Roundup Ready herbicides and were tested between 1998 and 2005. At the time Monsanto had applied to USDA for permission to develop the engineered wheat, but the company later pulled its application.

The Agriculture Department said that during that seven-year period, it authorized more than 100 field tests with the same glyphosate-resistant wheat variety. Tests were conducted in in Arizona, California, Colorado, Florida, Hawaii, Idaho, Illinois, Kansas, Minnesota, Montana, Nebraska, North Dakota, Oregon, South Dakota, Washington and Wyoming.

During that testing and application process, the Food and Drug Administration reviewed the variety found in Oregon and said it was as safe as conventional varieties of wheat.

In a statement issued Wednesday, Monsanto noted that this is the first report since its program was discontinued.

"While USDA's results are unexpected, there is considerable reason to believe that the presence of the Roundup Ready trait in wheat, if determined to be valid, is very limited," the company said.

USDA officials confirmed they have received no other reports of discoveries of genetically modified wheat. Michael Firko of the Agriculture Department's Animal and Plant Health Inspection Service and Acting Deputy Secretary of Agriculture Michael T. Scuse said they have already been in touch with international trading partners to try and assuage any concerns.

"Hopefully our trading partners will be understanding that this is not a food or feed safety issue," Scuse said.

Something everyone has struggled with at some point in their lives. But what actually is self-esteem and how does it affect you?

Broken down, the word ?esteem? refers to something or someone that is important, special or has a certain value. For example, if you really admire your friend?s brother because he volunteers at the local hospital, it means you hold him in high esteem. And ?self? simply refers to yourself as the subject. The dictionary defines it as ?a feeling or pride in yourself.? You can?t touch it, smell it, see, taste or hear it and yet it can have a huge impact on how you feel.

Here at One-Eighty, we focus on building up the self-esteem of the young people we work with in addition to maintaining positive self-esteem within our own team. Why? Because it?s important to know who you are, what you are and are not so good at, and the different aspects you can improve on. It?s not about being perfect, because nobody is. Nor is it about comparing yourself to others, but it?s about being confident in who you are and striving to like yourself for that reason. A positive mind-set equals a positive outset. Of course you need to be realistic in your achievements and learn that failure isn?t always a negative thing ? you can learn from mistakes which builds upon your character.

Having high levels of self-esteem enables you to respect yourself and equally gain respect from adults and peers. How do we get this? Well, it begins from childhood where as a baby you are praised for your achievements through verbal encouragement, body language and facial expressions. As you grow older, these become more conscious to you and you are able to understand the praise given to you and therefore channel it towards something. This may be when you?ve completed a piece of work, you?re praised for your efforts which in turn gives you a sense of pride in yourself.

In order to maintain or boost self-esteem it is important to try out the following:

- Make a list of things you are good at.

- Accept compliments given to you by saying ?thank you? and not dismissing them.

- Respect who you are and remember there are some things you cannot change.

- Get involved in a hobby that you enjoy.

- Spend time with people who encourage you and you have fun in their company.

- If you?re a parent or teacher, make a rewards chart with your child to visually praise them for their achievements.

Part of growing up is about learning to accept who you are, focus on the positives and learn from the negatives. Everyone has strengths and weaknesses but it?s about how we channel them that?s important. Sally Engle Merry is among the most distinguished law and society scholars in the world today and the leading legal anthropologist in the USA. With outstanding scholarship on human rights, colonialism, gender, race and class, local and popular justice, conflict resolution, and violence against women, Professor Merry has established herself as a towering figure in the Law and Society movement, drawing praise from scholars emerging from a plurality of disciplines, from law to sociology, ethnology, and anthropology.

A prolific writer, she is the author of eight monographs and close to 150 scholarly articles. Professor Merry?s most recent work Human Rights Monitoring and the Question of Indicators on the use of indicators in global governance addresses some of the most complex contemporary issues in the implementation of international human rights norms and serves to shape local and global governance through groundbreaking interdisciplinary studies.

Recognition of Professor Merry?s distinguished contributions to scholarly communities include the J.I. Staley Book Prize from the School of Advanced Research, the Harry J. Kalven, Jr. Award?for Outstanding Scholarship in Law and Society from the Law and Society Association, and being named a Chancellor?s Distinguished Fellow by the University of California, Irvine.

Sonos is already one of the most flexible music systems available, and with the latest 4.1 update to its controller software for iOS, OS X, Android and Windows, it's gotten even better.

Improvements include the ability to create playlists without using the queue - all you have to do is choose a track from any available source and add to your Sonos Playlist. You can edit playlists easier, too.

If you have a Spotify account, Sonos has some improvements there, too - you can create and edit Spotify playlists, and access and play music from Spotify playlist folders using your Sonos controller. You can also use Facebook or Spotify account credentials to link Spotify to Sonos.

New alarm options have been added and Sonos has improved component update speeds.

Afghan officials say insurgents attack Red Cross

KABUL, Afghanistan (AP) ? Afghan officials say insurgents have attacked a guest house used by the International Committee of the Red Cross in the eastern city of Jalalabad.

Ahmad Zia Abdulzai, a spokesman for the governor of Nangarhar province, says the attack began Wednesday evening and that a gun battle was still going on.

Provincial police spokesman Hazrat Hussain Mashreqiwal also confirms the attack on the guest house.

Both say an explosion preceded the attack, but it the source of the explosion was not immediately clear. They had no other details.

The Red Cross in Kabul says it cannot confirm the attack

An AP photographer at the scene says smoke can be seen from the vicinity of the guest house and shooting can be heard.

NKorea sanctions squeeze cash for aid groups

PYONGYANG, North Korea (AP) -- New international sanctions aimed at thwarting North Korea's nuclear weapons program are having unintended consequences: halting money transfers by foreign humanitarian groups working to help those most in need and forcing some agencies to carry suitcases of cash in from outside.

At the same time, some restrictions are meant to sting the country's elite by crippling the import of luxury goods, such as yachts, fancy cars and jewelry. But they do not appear to be stopping the well-heeled from living large in the capital Pyongyang.

Much of the aid group difficulties are linked to the state-run Bank of China's decision earlier this month to follow Washington's lead and sever ties with the North's Foreign Trade Bank, the main money transfer route for most foreign organizations, U.N. agencies and embassies in Pyongyang. With that line cut, aid workers in North Korea say they are left with few other options to receive foreign currency for expenses including rent, bills and salaries for local staff.

The sanctions are not supposed to affect humanitarian aid, but six Pyongyang-based aid organizations headquartered in Europe issued a communique earlier this month spelling out their frustrations and calling the difficulties in transferring money to North Korea a "big problem." They warned that they may be forced to suspend their operations if they cannot find ways to access cash. A handful of American non-governmental organizations also work in North Korea, but they cycle in and out and do not maintain a permanent presence.

Gerhard Uhrmacher, program manager for German humanitarian aid organization Welthungerhilfe, said when recent bank transfers failed, he managed to keep projects running by routing 500,000 euros ($643,000) to Chinese or North Korean accounts in China to pay for building supplies and other goods.

He said Welthungerhilfe, which signed the communique and works on agriculture and rural development projects in North Korea, has some reserves in Pyongyang but must also resort to carrying cash into the country by hand.

"It doesn't give a good impression. We're trying to be transparent, to be open to all sides and now we're more or less forced to do something that doesn't really look very proper because people who carry a lot of cash are somehow suspect," said Uhrmacher who is based in Germany and has worked in North Korea for the past 10 years.

"Whatever you're doing, everybody looks at you very closely," he said. "That's why we don't like it because bank accounts are proper. Everybody can have a look at it and everybody can control it. Now we are forced to do something else."

Some analysts said aid groups were simply "collateral damage" and that they will find a way to work around the sanctions as they have been forced to do in other countries. Others said the poorest North Koreas would be hurt if some humanitarian groups have to pull out of the country. The aid groups work on a range of issues from food security to improving health and assisting with disabilities.

Aid groups "may not provide as much support as governments, but they have the ability to reach the deep corners of the impoverished North where people are in most need," said Woo Seongji, a professor of international relations at Kyung Hee University in Seoul. "Their help is both symbolic and substantial. It reaches kids, hospitals and food shelters that outside governments may not be able to support consistently because of political considerations."

The latest sanctions have added challenges to the already difficult system of getting money into North Korea since ally China has restrictions on how much foreign currency can be legally taken beyond its borders.

Sanctions and trade embargoes have long been used by the international community to put an economic squeeze on troublesome regimes from Iraq and Myanmar to Cuba. But they are a blunt tool that can unintentionally add to the suffering of people living under oppressive rule by hindering development and the delivery of aid.

In North Korea's case, the sanctions are meant to stop financing and the smuggling of cash that could help its nuclear and missile programs. They also aim to send a message to the country's elite by crushing the import of luxury goods.

Yet last week at the newly opened six-story Haedanghwa Service Complex in Pyongyang, well-dressed North Koreans chatted on mobile phones and browsed in a high-end boutique that sold everything from fine Italian suits and Dior makeup to glass showcases glittering with diamonds and gold.

The opulent center boasted 17 different themed dining rooms and cavernous banquet halls, some with their own bathrooms and round tables big enough to seat 30 people. Upstairs, young couples played pool, lounged in the sauna and munched on sushi while sipping cans of Coke and beer. Others splashed in a heated indoor swimming pool replete with waterfalls or worked out at a fitness center filled with state-of-the-art equipment. Downstairs at a popular restaurant, a chef delighted guests by cooking on a grill in front of them ? at a cost of $50 a plate, not including drinks.

Meanwhile, at the airport, a Toshiba 42-inch flatscreen TV slowly made loops on the baggage carousel. All proof that high-end merchandise is still making its way to the upper class in an impoverished country where two-thirds of its 24 million people don't have enough to eat.

Uhrmacher said that despite repeated European Union vows that sanctions will not affect humanitarian aid, the pinch is being felt by all the organizations working in North Korea. The EU has not sanctioned Foreign Trade Bank, but he said due to U.S. political pressure and fears of becoming entangled in controversy, European banks do not want to be associated with it. Bank of China had typically been used as a channel to route money to the aid groups' North Korean accounts.

Most foreign embassies, NGOs and businesses have accounts at FTB or the Daedong Credit Bank. Daedong was named in an earlier round of U.S. sanctions, leading many embassies and NGOs to open accounts at the FTB.

"We are concerned regarding possible unintended effects of certain sanctions, in particular with regard to humanitarian assistance, and stress the need to overcome these unintended effects," said Maja Kocijancic, spokeswoman for EU foreign policy head Catherine Ashton.

The U.S. Treasury Department hit the North Korean bank with sanctions in March, effectively cutting it off from the U.S. financial system after accusing the country's main foreign exchange institution of funding Pyongyang's missile and nuclear programs. Washington pressured Beijing to also impose restrictions on the bank a month after new leader Kim Jong Un angered his biggest economic supporter by conducting an underground nuclear test.

The U.N. responded to that move by slapping Pyongyang with its toughest-ever sanctions. Tensions then boiled and North Korea spewed threats for weeks, including plans to launch nuclear strikes against the U.S. and its allies. The mood has since cooled, with the North sending a high-level envoy to Beijing last week to deliver a message that they were willing to take steps toward rejoining stalled nuclear disarmament talks.

Embassies and U.N. agencies are also affected by the banking transfer issues, but several officials refused to comment due to the sensitivity of the issue. However, the U.N. in Pyongyang said last month that the sanctions were hurting its ability to raise funds, resulting in a shortage of drugs and vaccines. The World Health Organization also said it's harder to import equipment and medicine because everyone has become over cautious at all levels before clearing materials.

The World Food Program said it has not yet been affected by the banking problems. It only needs limited funding within North Korea as financial transactions for its food aid are completed outside the country.

Ever since the United States Supreme Court decided its first same-sex harassment case, employers have struggled to define what is illegal same-sex harassment and what?s not. Now the 2nd Circuit Court of Appeals has provided some employer guidance in a case involving male-on-male harassment.

Recent case: Jeffrey sued his em??ployer after enduring what he described as his supervisor?s outrageous same-sex har??assment. Jeffrey claimed that over several years, his boss regularly grabbed Jeffrey?s crotch, made sexual comments and generally picked on him. Jeffrey recounted numerous sexually oriented insults and derogatory statements such as ?faggot, get the shovel and clean out the drain.? Plus, Jeffrey said that during a work-related argument, the supervisor grabbed Jeffrey?s testicles.

Jeffrey also described his supervisor?s behavior toward other male employees. They, too, were allegedly subjected to grabbing and touching of their private parts. Women, however, were apparently never targeted and were able to go about their business without interference.

The trial court tossed out Jeffrey?s case, reasoning that because neither Jeffrey nor the supervisor were homo??sexuals, the behavior Jeffrey described wasn?t related to Jeffrey?s sex or sexuality. The court said it was merely crude and unprofessional.

The 2nd Circuit Court of Appeals disagreed. It pointed out that Jef??frey?s sex likely was a factor in the harassment, since women weren?t similarly singled out. The court sent the case back for a jury trial. It also noted that if what Jeffrey said was true, the supervisor?s behavior could meet the test for pervasive or severe harassment.

The court also rejected the em??ployer?s argument that it wasn?t liable because Jeffrey hadn?t complained about his supervisor. Jeffrey told the court that he spoke with several other managers about the problem and had either been told there was nothing that could be done about it or was simply ignored. (Barrows v. Catholic Church's Top Exorcist Claims He Rid World of 160,000 Demons

The Catholic Church's top exorcist Father Gabriele Amorth.

Father Gabriele Amorth, 88, who also heads the International Association of Exorcists, told The Sunday Times?that he will ask Pope Francis to allow all priests the right to do exorcisms without the church's approval. According to the report, priests currently need special approval from their bishop to perform the rite and it is rarely granted.

"I will ask the pope to give all priests the power to carry out exorcisms, and to ensure priests are properly trained for these starting with the seminary. There's a huge demand for them," said Father Amorth.

He explained that he was inspired to make the request after watching Pope Francis perform what he insists was an exorcism on a man "possessed by four demons"?in St. Peter's Square.

"The pope is also the Bishop of Rome, and like any bishop he is also an exorcist," Amorth reportedly told?La Repubblica newspaper. "It was a real exorcism. If the Vatican has denied this, it shows that they understand nothing."

"There was now, more than ever, a need for exorcists to combat people possessed by 'sorcerers' and 'Satanists,'" he noted in that report.

An 84-page update of exorcism rites compiled in 1614 and drawn up in 1998 stipulates how Catholic priests trained as exorcists should operate. According to the guidelines established by the church, they have to follow a ritual known as "De exorcismis et supplicationibus quibusdam," or "Of exorcisms and certain supplications."

Amorth explained?that Pope Francis' exorcism on May 19 helped to balance the growing atheism in the world where people don't believe in the Devil anymore.

"We live in an age in which God has been forgotten. And wherever God is not present, the Devil rules," said Amorth.

"Today, unfortunately, bishops don't appoint sufficient exorcists. We need many more. I hope that Rome will send out directives to bishops around the world calling on them to appoint more exorcists."

Amorth is also an outspoken critic of yoga and Harry Potter books and dismissed them as ungodly hobbies.

"Practicing yoga brings evil as does reading Harry Potter. They may both seem innocuous but they both deal with magic and that leads to evil," he said.

In addressing Harry Potter, he said: "People think it is an innocuous book for children but it's about magic and that leads to evil. In Harry Potter the Devil is at work in a cunning and crafty way, he is using his extraordinary powers of magic and evil."

"Satan is always hidden and the thing he desires more than anything is for people to believe he does not exist," he noted. "He studies each and every one of us and our tendencies towards good and evil and then he tempts us."

The commander in chief arrived at the East Room for an event Tuesday night honoring Asian-Americans and Pacific Islanders?one of whom had shown him some love.

There to speak of their contributions, he began his remarks by discussing a very red mark on his collar left by an attendee.

"I want to thank everybody who?s here?the incredible warmth of the reception. A sign of the warmth is the lipstick on my collar," Obama said to laughter.

"I have to say I think I know the culprit?where is Jessica Sanchez?" the president said to more hoots, referring to the "American Idol" runner-up who was in attendance. "Jessica?it wasn?t Jessica. It was her aunt. Where is she? Auntie, right there. Look at this."

The president pointed to the red lipstick stain on his light blue shirt.

"I do not want to be in trouble with Michelle," Obama said, "so I'm calling you out."

On a serious note, Obama, whose remarks were made in conjunction with Asian-American Pacific Islander Heritage Month, called on better immigration laws to honor their history of building and defending the country.

Soldier to admit Afghan massacre

SEATTLE (AP) ? The Army staff sergeant charged with slaughtering 16 villagers during one of the worst atrocities of the Afghanistan war has agreed to plead guilty in a deal to avoid the death penalty, his attorney told The Associated Press on Wednesday.

Staff Sgt. Robert Bales is scheduled to enter guilty pleas to charges of premeditated murder June 5 at Joint Base Lewis-McChord south of Seattle, said lawyer John Henry Browne. A sentencing-phase trial set for September will determine whether he is sentenced to life in prison with or life without the possibility of parole. The judge and commanding general must approve a plea deal.

Browne previously indicated Bales remembered little from the night of the massacre, but he said the soldier will give a full account of what happened before the judge decides whether to accept the plea.

Bales, an Ohio native and father of two from Lake Tapps, Wash., slipped away from his remote southern Afghanistan outpost at Camp Belambay early on March 11, 2012, and attacked mud-walled compounds in two slumbering villages nearby.

Most of the victims were women and children, and some of the bodies were piled and burned. The slayings drew such angry protests that the U.S. temporarily halted combat operations in Afghanistan. It was three weeks before American investigators could reach the crime scenes.

Bales was serving his fourth tour in a combat zone, and the allegations against him raised questions about the toll multiple deployments were taking on American troops. For that reason, many legal experts believed it that it was unlikely that he would receive the death penalty, as Army prosecutors were seeking. The military justice system hasn't executed anyone since 1961.

Nevertheless, the plea deal could inflame tensions in Afghanistan. In interviews with the AP in Kandahar in April, relatives of the victims became outraged at the notion Bales might escape the death penalty and even vowed revenge.

"For this one thing, we would kill 100 American soldiers," said Mohammed Wazir, who had 11 family members killed that night, including his mother and 2-year-old daughter.

"A prison sentence doesn't mean anything," said Said Jan, whose wife and three other relatives died. "I know we have no power now. But I will become stronger, and if he does not hang, I will have my revenge."

Three of Jan's other family members were wounded, including his 7-year-old granddaughter, who was shot in the head.

NBA approves Kings sale to Sacramento group

NEW YORK (AP) -- The NBA Board of Governors unanimously approved the sale of the Sacramento Kings on Tuesday to a group led by TIBCO Software chairman Vivek Ranadive.

The league said in a statement that the "transaction is expected to close shortly."

After owners blocked the relocation of the franchise to Seattle earlier this month, the Maloof family reached an agreement to sell a 65 percent controlling interest in the Kings to Ranadive's group at a total franchise valuation of $535 million. Ranadive, who will have to sell his minority stake in the Golden State Warriors, becomes the NBA's first Indian-born majority owner.

The Sacramento group also includes 24 Hour Fitness founder Mark Mastrov, former Facebook senior executive Chris Kelly and the Jacobs family that owns communications giant Qualcomm.

Moments after the league announced the sale was approved, Ranadive thanked owners in a tweet and wrote that it was an honor and a privilege "to be part of such an amazing community." He also updated his Twitter profile to show that he is the owner of the Kings.

The vote, which had been expected since owners blocked the move to Seattle on May 15, officially ended an emotional saga that has dragged on since January. And for those in Sacramento, almost a decade of uncertainty involving the Maloof family, who entertained relocations to Anaheim, Calif., Las Vegas and Virginia Beach in recent years.

No threat of relocation had been more serious than Seattle.

Chris Hansen had a deal with the Maloofs to buy the Kings and rebrand them the SuperSonics, who left Seattle for Oklahoma City in 2008 and were renamed the Thunder. In a 22-8 vote, the Board of Governors rejected that deal, which would have sold a 65 percent controlling interest at a total franchise valuation of $625 million.

Hansen has vowed to continue his fight to bring the NBA back the Pacific Northwest city.

The next steps for Ranadive will be figuring out the basketball operations and finalizing the deal for a new arena. He already has been busy helping staff sell season tickets and boost sponsorship.

The contract for Kings president of basketball operations Geoff Petrie expires after June 30 and he is not expected to return. Coach Keith Smart is signed through this upcoming season; however, most of his assistants are not.

Sacramento Mayor Kevin Johnson - a former NBA All-Star guard - got the City Council to approve a non-binding financing plan for a $447 million facility with a $258 million public subsidy. But that deal is still pending environmental and other reviews.

Builder of 1st phase of California's bullet train faces scrutiny

The state bullet train agency is pushing full throttle to start construction of the important first phase of the California high-speed rail system in as little as six weeks, prompting scrutiny of the state's selection of a construction company with the worst technical scores among bidders.

Tutor Perini Corp. won the competition to build the first 29 miles of the high-speed rail route on a low bid of $985 million, even though its design quality, safety plan and engineering, among other factors, ranked at the bottom of five teams seeking the work.

The highest-scoring team, led by the Spanish firm Ferrovial, bid $1.4 billion. The second-highest scorer, led by the Spanish firm Dragados, bid about $100 million more than Tutor.

A state Senate committee, a subcommittee of the U.S. House of Representatives and the state auditor, among others, are looking at a variety of issues and allegations about the project, even as the state begins buying the first parcels of land ahead of the planned start of construction in July.

The House subcommittee on rail, chaired by Rep. Jeff Denham (R-Atwater), a bullet train critic, is expected to demand a detailed explanation of how the selection was made when he opens a hearing Tuesday in the San Joaquin Valley city of Madera, near where Tutor Perini would first sink its shovels into the ground.

"My biggest concern," Denham said, "is that somebody could come in low and we would see wild change orders and wild price increases and the contractor would make money on the back end."

Denham said the project was "out of control" and was putting the state at risk of squandering billions of dollars on a system that could be abandoned partially built. He added that no construction should occur until legal disputes are settled, required environmental reviews are completed, and voters are given a chance to approve the growing cost of the $68-billion project.

Rail authority Chairman Dan Richard says that the project has made tremendous progress this year and that Tutor's price will save the state money.

The initial 29-mile stretch would run south from near Madera toward Fresno, reshaping the state's fifth-largest city with a 1.7-mile trench, a 1.2-mile viaduct and three major bridges.

The construction includes building a long tunnel in a pit and then pushing it into place with giant hydraulic jacks, a technically complex job that has seldom been done in the United States.

The federally funded portions of the project must be completed by 2017 to avoid potentially forfeiting grants, which would add to the project's problems with long-term financing. Of the $68 billion, the Government Accountability Office, an arm of Congress, has estimated the project is short more than $38 billion.

Tutor Perini and its team, which includes Pasadena-based engineering firm Parsons Corp., will also do most of the design and engineering work.

Tutor Perini may have won the bid because of an unusual move by the state, which weighted 70% of its decision on cost and 30% on technical merit. The Design Build Institute of America recommends that government agencies put most of the emphasis on technical scores.

The state also tilted the competition for the low bidder last August when it changed an original plan that would have disqualified the two bidders with the lowest scores from getting the contract.

The authority made low prices a top priority, even offering Chief Executive Jeff Morales a $25,000 bonus when he was hired if he could bring in the bids at or below estimates, among nine other criteria. Rail authority officials say payment of the bonus will be decided by the board in the future.

Before Tutor Perini was selected some financial analysts predicted that it would win the competition only because of its chief executive's close ties to organized labor, one of the project's biggest supporters.

The board of the California High-Speed Rail Authority is expected to award Tutor Perini the contract when it meets next month based on a recently issued recommendation from its staff.

The state has said little about why it scored Tutor Perini's proposals significantly below the two Spanish firms, which have extensive bullet-train experience in Europe.

In addition to Denham, several groups critical of the rail agency said the state was buying down to the least qualified company, an allegation that infuriates Tutor Perini Chief Executive Ron Tutor, who insists that he has far greater expertise than his competitors.

"It is the usual nonsense of people who have no idea how construction functions," he said in an interview. "There is no buying down anything. The fact that they scored the points only meant in their consultant's eyes rightly or wrongly ? we could debate that forever ? they liked the design better from the Spanish.

Insurance Premium Reductions ? Follow Up #2 ? Workers ...

Following WorkCover NSW?s recent announcement of industry rate reductions (see the original article here, and our follow-up here), further details of changes made to the Scheme for small employers have now been made available.

WorkCover states that the changes are intended to decrease administration and create savings for smaller businesses, while increasing focus on injured workers, and providing small employers with more incentive for proactive claims management.

These changes will be effective for policies renewing 30 June 2013 onwards, and please note that all of these changes relate ONLY to small employers.

Changes include:

  • Small Employer Definition ? The small employer limit has been increased from $10,000 to include employers with an annualised Basic Tariff Premium (BTP) of less than or equal to $30,000. This means that premiums of employers with an annualised BTP of $30,000 or less will not be impacted by claims cots. BTP is calculated by multiplying your wage roll by the WorkCover set rate for your industry.
  • Renewal Premium ? Agents will no longer ask small employers to provide a declaration of estimated wages. The 2013/2014 premium will be based on the current year?s estimate. From 2014/2015 onward, the renewal premium for small employers will be calculated on the actual wages, plus a determined adjustment factor such as the CPI (Consumer Price Index). If actual wages are not submitted, the renewal premium will be determined using the estimated wages plus 30%. If wages are expected to differ by 25% or more from the renewal figure, the agent can be advised and the premium amended.
  • Adjustment Premium ? The timeframe to submit the declaration of actual wages has been increased from two months after the end of the insurance period, to four months. If the declaration is not received within six months, the premium will be nil adjusted.
  • 5% Premium Discount ? If the annual premium is paid in full by the due date, the early payment discount is now 5% instead of 3%.
  • Employer Safety Incentive (ESI) ? Each policy year if all injured workers? return to full time pre-injury duties with 4 weeks of the date of injury a 10% reduction in premium will be given by WorkCover. This discount will be automatically applied, and will only be removed if the employer doesn?t meet the conditions during the year.
  • Return to Work Incentive (RTWI) ? If the employer doesn?t meet the conditions for the ESI (above), they can still get a 10% discount if every worker injured during the policy period returns to work within 13 weeks from the date of injury. The RTWI is applicable only if the employer is no longer eligible for the ESI.
  • Renewal Dates ? A small employer?s policy will be adjusted to align to the end of the calendar month prior to the current renewal date, if it does not already align to a calendar month end. E.g. a 29 September policy will be shortened to expire on 31 August.

Microsoft Announces Surface Pro Pricing in Singapore

Microsoft will officially launch the new Surface Pro tablet in Singapore on June 3, with the same two models with 64 GB and 128 GB of storage space to be offered to buyers.

A report published by TechGoondu also reveals pricing details, with the entry-level model to be available for S$1,198 ($947 / ?735). The top-of-the-range 128 GB version will be sold for S$1,328 ($1055 / ?815).

As far as the Surface product family is concerned, rumor has it that Microsoft plans to expand it with new members as soon as June. While the company is expected to introduce new Surface tablets at BUILD, it could also launch a smaller device later this year.

      I trade currency (Forex, FX etc). This market is minimally regulated & is significantly larger than the US Stock market. 90% of all the people that try Forex trading lose all their money. Of the winners.... they lose 40% of all their trades.

      Many brokers actually trade against you. They make money when you lose money.

      I love this market.... but.... take six months to a year before you put in 1 cent. Learn the skills you'll need. Practice. Backtest. Start out very small. Don't believe 90% of what you see from the brokers. Always move slowly. Part of the way to win in this market is picking trades carefully. It's always better to not trade than lose money.

      This is 100 times more riskier than stocks.

      Mostly all brokerage firms provide their clients with on-line services, including trading platforms, latest market & financial news and research.

      Customer need to select the site that is best for them. Traders have requirements in a site, while investors have other requirements.

      Although most sites are geared to general securities and commodities, however customers may have special needs for the types of products they trade, and the markets in which they trade.
